Terms of service

Please read these Terms and Conditions (“Terms“) carefully before using the Bunch CRM website at https://bunchcrm.com or the Bunch CRM software and related services (collectively, the “Service“), operated by Bunch CRM (“Company,” “we,” “us,” or “our“).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Account Registration

You must provide accurate, current, and complete information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use.

3. Subscription Plans, Fees, and Billing

  • Certain features of the Service require a paid subscription. Fees, billing cycles, and available plans are described on our pricing page.
  • Fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law or as expressly stated in these Terms.
  • We may change our fees upon reasonable notice. Continued use of the Service after a fee change constitutes acceptance of the new fees.
  • You authorize us (or our payment processor) to charge your chosen payment method for all applicable fees.
  • Failure to pay may result in suspension or termination of your access to the Service.
  • A free trial, if offered, will convert to a paid subscription at the end of the trial period unless canceled beforehand.

4. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes.

You may not:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, rent, or lease the Service to third parties.
  • Use the Service to build a competing product.
  • Circumvent any security or access restrictions.
  • Use the Service for any unlawful, harmful, or fraudulent purpose.
  • Upload malicious code or attempt to disrupt the Service's infrastructure.
  • Use automated means (bots, scrapers) to access the Service without our written consent.

5. Customer Data

  • Ownership: As between you and us, you retain all ownership rights to the data you upload or input into the Service ("Customer Data").
  • License to Us: You grant us a limited license to host, store, process, and display Customer Data solely to provide and improve the Service.
  • Your Responsibilities: You are solely responsible for the accuracy, legality, and appropriateness of Customer Data, and for obtaining any necessary consents from your own customers or contacts before uploading their information.
  • Backups: While we take reasonable steps to back up data, you are responsible for maintaining your own backups of critical data.

6. Intellectual Property

The Service, including its software, design, branding, logos, and content (excluding Customer Data), is owned by Bunch CRM and protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

7. Third-Party Integrations

The Service may allow integration with third-party applications. We are not responsible for the availability, content, or practices of third-party services, and your use of them is subject to their own terms and privacy policies.

8. Suspension and Termination

We may suspend or terminate your access to the Service, with or without notice, if:

  • You breach these Terms
  • Your account is delinquent on payment.
  • We reasonably believe your use poses a security, legal, or reputational risk to us or other users.
  • Required by law.

You may cancel your account at any time through your account settings or by contacting [email protected]. Upon termination, your right to use the Service will immediately cease. Certain provisions (e.g., intellectual property, disclaimers, limitation of liability) survive termination.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUNCH CRM AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE [12] MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Bunch CRM from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, or your violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new “Last updated” date and, where appropriate, via email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. General Provisions

  • Entire Agreement: These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Bunch CRM regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions will remain in full effect.
  • No Waiver: Our failure to enforce any right or provision will not be considered a waiver of those rights.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
